6:00

course we chose the hottest day of the year to do this record this one yeah can I tell you what I almost was and I'm actually so glad I didn't do it I wanted to but I was like I need to execute on this perfectly please tell me and the fact that I'm already sweating this much in this costume it would have died tell me the Grinch oh that would have been such a good one especially cuz my belly is like perfect like my body is proportioned exactly as the Grinch right now oh that would have been so good next time I'm pregnant can I tell you what I was going to be yeah I was going to be a baby and be your baby how many people would have been disturbed by that I think it would have been very disturbing well then I was like okay but it could double as like Tommy from Rugrats yeah wait oh that would have been so funny because another one of my options was I thought about going as Captain Underpants if we both Shir up as different variations of babies babies that would have been good that could be something we do in October in October any who we've gathered here today we have to discuss something of the

7:00

worldly something terrifying terrifying more terrifying than having scissors as hands actually I don't know what you're talking about today oh well I will tell you I actually got inspiration because so we have a cameo and someone's mother bought them a cameo for their birthday but they had just graduated law school oh congratulations I know I said it but just Sayang it again you're saying it as if you weren't there to make the but it just that's exciting yeah yeah yeah double congrats double congrats to you but it made me just like think about like law and you had covered one of the cases that was like the first legal defense of sorry then I'm likeing my stret character they're itchy really yeah sometimes well I'm sweating they don't look that bad well thanks but they're they're a little itchy cuz they're fresh and raw and I'm just funing but anyway I was just like thinking about how you covered like one of the first legal cases about like a haunted house not being disclosed as haunted house and stuff like that yeah and then I just discovered that there is

8:00

a case that is kind of related to like adjacent to paranormal activity that is taught in every single or supposedly I haven't been to law school but they say it's taught in every single Tor class oh in law school it's like one of the famous famous cases I love that and I feel like they Breeze over the Paranormal part but I'm not going to we're not yeah we're here to re-educate all of you law students properly you're going to learn today my God I am like literally going to you're going crazy for face paint I'm going crazy with the hair but we were talking before about how nice it would have been cuz it's 85 degrees today in Boston if we were recording from a pool and that would have been even better like the leg blond oh man damn it missed opportunity let's let's go jump in your neighbor pool in these outfits guys can everyone tell like 30 of their friends to watch our podcast so I can afford to put pool in my backyard cuz as of right now I'm like we're like barely using the

9:00

air conditioning as but we are going to learn about an Infamous case a case that any lost students out there might know of it is the catco versus Briney case oo so in

Story Begins - Katko V Briney

1957 in Eddyville Iowa great year great year the best year actually we know it well this is cutting off my circulation is it I think so oh you could take them off but then I wouldn't be the part Bertha Briney she was a little bit older at this point her and her husband they were nearing elderly and so it's no surprise that their parents you know and and I guess like parents-in-law were not doing well and actually Bertha both of her parents passed away and in them passing away of old age they inherited Bertha and her husband Edward Ed they inherited Bertha's parents old farmhouse and it's in this really rural area of Iowa they lived like kind of close but not really and there were 80 acres of

10:00

land [ __ ] yeah sounds sick but knowing where this is going to go I feel like it's probably not well I don't think you do oh okay this is why it's kind of exciting you're assuming haunted house but it is a little bit more than that so the town itself of Eddyville it was small it had just around a thousand residents there and the Main Street consisted of two blocks which basically just had like the essential so it's like here's the grocery store here's the gas station here's the bank that probably gets robbed a lot yeah even if there like maybe there wasn't a bank right maybe it was just everyone had a PO Box I don't know yeah yeah but before Bertha's parents lived there her grandparents lived there so this was a a town and a farmhouse that had been passed down now she's like the third generation to inherit it so obviously it has a special OB has a special place yeah it's family property so while The Brines didn't move into the house they it was kind of run down honestly they did decide that they would keep the house right so it wasn't really paid off yeah yeah I'm sure and it was an

11:00

inheritance and something to pass down maybe to Future Generations but they also weren't ew I hate that feeling that was atrocious Behavior I didn't know my cover it cover it quick sorry it was an intrusive thought and I had to do it honestly I barely felt it I knew there was a little something going on down there but I didn't really until I saw your face and your scissor it's fine I'm sweating my ass you scissored my hole just scissored your hole Jesus Christ how many times can you say you did that well I don't know you've got a lot more scissors on your hand so sciss on the street watch out so the Ries they decided not to move into the house and you might be thinking like okay well they're keeping it for future Generations perhaps they're keeping it as a property to go have like little getaway in the summer time like a nice

12:00

summer night just sit and listen to all the cada taking over the world look at the lightning bugs yeah crickets no they did not keep The Farmhouse for that reason the reason they kept The Farmhouse was because Ed and Bertha were convinced that Bertha's parents the spirits of her deceased parents still lived there oh that's sweet it is kind of sweet but they kind of took it to the extreme so so like basically they were treating it as if they were actively still living in the house and they could not touch it because it was their home not like her parents home not hers right yeah and like we all cope with death in different ways but the way that they coped was truly actively believing that the spirits of Bertha's parents lived there and that they were going about their lives and they basically treated the house as if they were taking care of her elderly parents still so they it's kind of like um what's that movie Psycho where he killed his mom but like still acts like she's alive why am I blanking on his name Norman Norman Bites Norman

13:00

Bates there we go we got there so they basically wanted to ensure that her parents could live on in their astral being and like keep their same routines just in spirit form mhm so the house which really looked a bit run down and it looked abandoned and there was other properties on the land too that definitely were like a bit dilapidated and so that just added to this house looking a little bit more abandoned even though it wasn't it was just uninhabited by living people people and also 80 acres is a lot of land if you're not living there and maintaining it I'm sure it looked super unruly I think the yard was like yeah very like tall tall grass they didn't spend much time there so they did try to maintain it to the best of their abilities they kept all of the furniture inside all of the valuables all of her parents' clothes the jewelry everything the kitchen was stocked so they had the pantry and the fridge stocked with food they also put out like place settings and do because I don't know but

14:00

they didn't live too far away I think it's like basically like maybe they were the next town over a few 10 miles away or whatever like they had enough time to go check in on the property every once now I'm just picturing like a lot of rotting food with lots of flies and gross disturbing stuff that's what I pictured too but apparently it wasn't it just like really looked like maybe maybe like when you go into like a museum and they have all like the fake Foods out or whatever and like everything it's like oh this is how they used to live and there's a book on the counter and a play setting with a fake muffin like I think real muffin but this is a real muffin and that's essentially what it looked like okay so they were like should my parents should my in-laws find themselves hungry here they have plenty to eat they have a place setting everything's comfortable they can live exactly how they did they're going to have a great afterlife which isn't too different from like Egyptian pharaohs and people being buried with their yeah most valuable belongings it's almost like this living I mean it is different I know cuz that's like if they are reincarnated or come back but but it's not terribly unhinged no and no one

15:00

should care because it's not anyone else's property it's the BR want yeah they can do what they want it's not like it's on a main road and they're not murdering people no no like there's no unless you're actively seeking out this property you shouldn't be able to like look in it or see it or be bothered by it so mind your own business is basically what they wanted to happen but that's not what happened so they left the old farmhouse a little bit as a time capsule and Ed and Bertha they rarely spent time there but they did end up kind of like over the years going there more and more often because this old abandoned Farmhouse with 80 acres of land with everything inside but nobody inside was kind of intriguing to criminals and burglars and probably just teenage kids from town so they're the ones who should be getting in trouble exactly over the 10 years that the beras endured this house I guess and like left

16:00

it as this time capsule person after person broke into the old farmhouse the exact number was somewhere around 50 times so in a 10-year span they had over 50 break-ins that's what they saw or knew of right like think about people were actually thieving and like taking things away yeah so it's super frustrating right like they have this is their family home it's clearly something that they're very emotionally attached to and have this emotional charge too because they truly believe that berth is parents the ghosts of her parents live there so there's like some protection not only of the property but like of her parents and this episode is sponsored by home security it should be so they're very frustrated they obviously no one wants anyone to break into their house but like they especially are getting frustrated and they're a little bit older as well so it's not like if their belief is that their parents SL in-laws are still living there and existing there they probably feel so bad for them yeah like they're like now they're not able to live in this afterlife the way peaceful about it right so instead of

17:00

thinking H maybe I should start to potentially remove some of the valuables some things that I mean again I'm placing like I'm almost placing the blame on them right now which isn't fair to be like well if you don't want people to break in remove all your stuff that's not how it should be but like that was some people's train of thought and some people's suggestions to the pinies but they were like no we're not going to do that like this is our home we don't have to remove things and so instead they were like hey let's just put up a bunch of no trespassing signs all over the property and so over the years they just kept adding more and more like private property no trespassing signs and it didn't deter people I was going to say I feel like that's not going to stop people it didn't and So eventually they end up nailing the doors and windows shut so in some cases they have like a metal sheet in other cases it's just kind of like wood panels they nail shut so now is looking even creepier and creepier yeah exactly and less accessible to them too to like drop in and right yeah how do they hello and

18:00

whatever okay I I don't really know H but this still was not enough to deter people people were very curious about this house they were so tempted by this house just filled with treasures and no one on site to tend to it and it was also out in the middle of nowhere in a field so how easy was it to just break in and no one see you and 1957 like 100% CV footage did not exist then nope it was invented by a woman by the way what in case you didn't know yeah really [ __ ] yeah got to survey the land so a lot of people they were curious enough about it to go to The Farmhouse to just try to take a peak but there were obviously plenty of people who went with the intention of rifling through the items going inside stealing things and they did success successfully for many years despite attempts from two different County Sheriffs so they basically got like two different towns involved the Bry dead to try to deter people from going to the house to try to speak to the to try to do like you know

19:00

some general like Drive buys to make sure the property was okay like hey be a good neighbor yeah yeah and like oh a police officer is going to drive by here every once in a while so don't don't risk it but at a certain point if you're like the police I would be like well this is your property you don't live here like do something like I don't know I don't almost be like go live there if you're that concerned about it I know but that's another hard thing to say it's like right but there's only so much they can do the the police right and it's also very small towns like a town of a thousand people how much crime is truly happening and how many people are on the police force probably just the sheriff and like one other person yeah and it's like wife yeah likego oh I was thinking misery that too yeah yeah so The Brines they're constantly being disturbed the deceased parents their Spirits probably being disturbed as well and that is when Ed Bry went ding ding ding I have an idea what is something I can do that's even more intense than what we've already tried to do to deter people I will set

20:00

up a booby trap oh yeah and now I see where this is going Yep this is why it's okay in law school this is so fascinating isn't it the evolution of it right and it all started with just someone trying to cope with their parents' death right now it's becoming a little bit more unhinged where it's like zombie apocalypse let's protect this land with 100% yeah yeah so Ed grabbed his two gauge shotgun and he attached it to the iron bed frame in their primary bedroom he then ran a wire from the trigger of the shotgun to the bedroom door knob so essentially if someone were to open the door it would pull the trigger and they would get shot so Ed had positioned the gun to hit the enger cuz he's this is pretty well I feel like when you live kind of out in the middle of nowhere yeah you do this [ __ ] yeah yeah this was before a task ravit existed you just had to learn how to do things and like work your way through them so he sets this up so if someone open the door the intruder if it was an adult they would be shot in the Torso

21:00

okay Mrs Briney Bertha she was like oh my gosh I don't want this to be like a fatal shot I don't want anyone to die here we're just trying to deter people so she convinced Ed that they to Spook people away but not to kill anyone needed to keep the booby trap but point it more towards like the legs and the feet so someone would just get like their leg shot so it shouldn't be fatal hopefully if it doesn't hit a certain like artery I'm nervous about where this is going you're talking a lot about height it's not a child I'll just I'll I'll say that now so nobody knew that the bres had made these changes it had been 10 years of people successfully trespassing on the property breaking into the house stealing things no one knew that suddenly it was going to be a deadly choice to do so not that it was the brine's responsibility to start advertising that they sure they put no trespassing signs up for years they did and it's boarded up it should be difficult to get in yeah so why is it Ed

22:00

and bera's responsibility to let people know that if they illegally break in they will be shot it isn't right so they right law students but as if it's hard so they kept the trespassing signs as is and they left the house boarded up one Eddyville resident 28-year-old Marvin catco he had lived in the area his whole life and his family actually owned there's like the two blocks or whatever in town and one of those blocks has a gas station and that's his family's gas station so he worked there the only gas station yeah it's the only gas station I say through like deep breathing and lots of burps it's the only gas station so Marvin he worked at the gas station but on the side he was a bit of a collector he loved treasure hunting and antiques and his thing at the time was finding these old jars and bottles and things that he thought were of value right in that sort of regard so he'd obviously heard about this abandoned Farmhouse quote unquote I keep calling it abandoned it's not it was

23:00

just uninhabited right someone owns it and checks in on it and is aware of it monitoring it it's not someone's full-time residency I'm betting Marvin had been to the house prior to this so he had yeah previously he and his friend had broken in and supposedly they grabbed this like marble piece of furniture like dresser and stole it from the house that's probably heavy probably very heavy but like you got all the time in the world no one's coming over yeah if anyone does they're probably coming to thieve as well so they're like how'd you get in what'd you find anything good yep so Marvin and his friend they had one successful attempt in the past and now Marvin is super intrigued about like oh is there anything else in there that maybe we missed I should go look at the bottles I'm interested in antique uh canning jars and stuff like that so he and his friend they decide they're going to go back okay so they travel seven miles down the road to the Briny Farmhouse they walk past the dilapidated buildings on the property they walk through the high grass past the no

24:00

trespassing signs and they stand in front of a window that is boarded up they uncover the window and enter through the window because they found that it was much easier to do that than try to remove the amount of stuff I guess like debris nailed into the the front door sure so they're crawling through the window okay the two men get inside the friend is like I'll take the first floor I'll start in the kitchen I'll look around Marvin's like great I got upstairs M he opens the door to the primary bedroom mhm and the shotgun went off it struck him in the leg at very this is like Point Blank Range like this is very very close and this is a shotgun which doesn't that spray bullet like it's like the yeah the like pellets kind of like explode right yes and basically being shot this close at that sort of range it blew off a good part of his leg so Marvin's friend comes rushing to his Aid and assist him to the hospital and

25:00

Marvin had to spend 40 days in the hospital recovering cuz it was that bad damn when he was discharged from the hospital he was still in a cast for another year a brace for another year and his leg would never be the same again there was actually a lot of conversation it still attached it wasn't amputated no but that's what I was going to say there was a lot of conversation about like should they amputate it should they not he actually lost like 2 and 1/2 Ines of his leg or something like that like w he was just never the same like the leg would never be sure the same but he did end up keeping what he could of his leg right but he was dramatically injured like life would his Mobility would never be the same yeah so surely Marvin CCO regretted trespassing and breaking into the Briny Farmhouse and obviously he was caught because he had all these injuries he was staying at the hospital questions happen and he fully admitted to breaking in and what happened mhm so Marvin was initially charged with a felony that was dropped down to a misdemeanor and he pleed guilty okay the official charge

26:00

was that he was guilty to Larsen in the nighttime of property valued at less than $20 less than $20 so I don't know what he stole but I guess less than $20 interesting well did he actually did he successfully steal anything that night because he was I attacked you know or maybe it was just like it was $20 for the board that he took off sure that he broke yeah yeah maybe that's what it was I wonder if this successfully stopped anyone from breaking into that house ever again that's a really interesting question I'm not sure they ever had the opportunity to test that out okay because Marvin's hospital bills were quite large 40 days surely way more than what he attempted to steal yeah and in his I guess guilty plea He was ordered to pay $50 as well to who I don't know maybe the bres okay but then came a part of this case which kind of complicated things is why in the US a lot of people in law school know of this case Marvin catco after pleading guilty being injured and all this other stuff he then files a lawsuit against Ed and Bertha

27:00

bry right Marvin broke into their property illegally ignored the boarded up Windows and Doors not only ignored them broke through them broke through them yeah ignored the trespassing signs he'd stolen from them before this was a second attempt at this and now he was suing them so everyone's like question mark question mark question mark eyes popping out ahe what the [ __ ] and if you're asking for what it was malice and intent to harm by rigging the shotgun so basically the way the shotgun was set up there was intent to harm it wasn't just to like startle someone away from the property right it was excessive force or the intent to use excessive force and potentially maybe even fatally injure someone so the the point was or the intent was to shoot someone with a gun and also now this guy has Marvin has so many hospital bills he's like I can't pay for this yeah he's motivated yeah he definitely is and he's also injured for

28:00

the rest of his life from this event basically he and his legal defense his his lawyer are saying that excessive force was being used to protect the property and using a gun like that to protect your property is not the same as using a gun to protect yourself so if you were in the home and you're protecting against an intruder that's very different than just leaving this property unmanned with nobody inside and just deciding to shoot anyone who comes onto the property well there are two people Spirits inside so yes but I guess spectral self-defense is not viewed as legally okay yeah yeah it doesn't hold up in court unfortunately so the house was vacant or it was legally considered vacant no living humans inside and aside from valuables being stolen there was no damage being done so why couldn't the brines just remove their valuables if it was such a big deal why go through the trouble of trying to shoot someone law is so interesting cuz I feel like I'm I mean this is also coming from someone

29:00

who's not studied it but I feel like some cases are so much of like how can you skirt the law and twist it to fit your case and it is like it's very strategic it's there's loopholes there's so many loopholes and you can take this and twist it and into your favor also I just have to say this like one side tangent because it's like the most magical thing to happen to a lawyer I feel like who's pregnant but I have a relative who's pregnant and she's a lawyer and the first time she ever felt her baby kick was when she was like giving the defense like up and arguing and she got like kicked oh that's cute yeah like a everyone was fired up baby included baby included you baby's first legal defense cross examination baby lawyer coming fall 2024 that's Law and Order s SP sound it's a spin-off now Begins the part of copyright infringement I'm scissoring another hole oh God are

30:00

you okay Sven this seems not okay straight through the back of his neck so you can see why this is obviously a complicated case because it's like why is it the property owner's responsibility why is the health and safety of someone who has been told is trespassing yes yeah and not just trespassing like it's literally being told do not enter yeah and is doing it yeah so like why does it fall on that right so blame can go both ways and and that's kind of what happened in this trial mhm edenir a briny's lawyer argued that the law allows you to defend your property with quote all the force necessary but it doesn't give the specifics of what that force is so he was like well how can you be upset about this like there were no specifics if this is the way that it was it's not like there's room for interpretation there there totally is and also like this house have been broken into over 50 times in a decade items were stolen their property and themselves treated with very little so this did seem necessary mhm plus it's

31:00

not like they just went from Z to 100 like they over a decade were escalating it was like yeah okay now we added no trespassing sign okay now we add another one and another one and another one now we sheriffs come like yeah now we call the like they're really trying everything so this felt like the last thing that they could possibly do and it's not like they aimed it at the front door like anyone who would just come in like it was but also maybe that's another argument where it's like a little bit of a booby job like draw people in and then get them shot you know yeah but I guess you could argue there's no drawing them in yeah they're just it's not like hey come on inside and then let me shoot you when you get to the bedroom it's don't come in don't come in you came in your fault it's kind of like one of those things where I feel like people put up the beware of dog sign right to like people yeah but then also like even if you have a dog that would never hurt anyone like God forbid it bites someone or someone says that it does it's like well you were given all the warnings that there was a dog here on the and you chose to actively chose

32:00

to come in enter this premise yeah but I guess there was no like beware of shotgun beware of shotgun rigged shotgun inside it just said no trespassing okay does Marvin win okay sorry you can keep I'm just like in my head I'm like how I know it's really hard because there's so much back and forth yeah so this case was presented in front of a jury there were 12 female jurors 12 female jurors yes they were all female who were picked and things got a little heated is that allowed well I think jury selection is random interesting I thought it was supposed to be like a diverse group of your peers what do I know I'm not a lawyer well also this was in the 50s and also to your point like maybe both sides thought that an all female jury would help them you know like have the sympathy on either side interesting okay so at one point Ed and bera's lawyer snatched one of the juror's purses to show how horrible like mentally and emotionally it is to have one of your your things taken from you and feel so

33:00

defenseless yeah something you value Live Theater it was said that Marvin catco's lawyer was super pleased with the all female jury because he felt like it would help Marvin because Marvin was young likable he was attractive and he also was gaining I guess more empathy and respect during the case too because or like during the trial because he admitted to all of his wrongdoing he never tried to make up an excuse or justify his actions he was like yeah I did this like this was super shitty he was just there he was handsome he was injured and he needed to be cared for exactly yeah isn't that everyone's type at some point in their lives I'll save you yeah me throughout all of college Edward sits her hands is like a Marvin yes oh I felt so bad for for not for Marvin for for Eddie for siss hands cuz he's also just like being Tak advantage of by old women and it's yucky and gross

34:00

and he kind he's like yes save him save Edward's Scissor Hands I guess we're both actually dressed up as people who were really going through some [ __ ] at the time yeah are we okay I don't know this isn't meant to be funny these costumes this is just trying to show how we feel on the inside I like can't look at myself in in the I'm having a hard time looking at you too and I keep looking at your scars that you put on you like them yeah you like them like it also I didn't mention this before because it is a little bit gossipy and not really like actually put down legally in any of the uh in any of the documents but apparently Marvin and Briney or The Brines they had a history because Marvin as I said he previously had broken in and I guess the Bry knew that it was Marvin that broke in or like someone must have tattletail on him and so there are many nights that Ed bryy would actually spend the night posted up at the house with the gun supposedly he was like lying on the floor with a gun

35:00

oh waiting for trespassers waiting potentially for Marvin but again that was not in any of the legal documents that I saw that was kind of like a town gossip yeah and also like if the argument is that they weren't protecting themselves then wouldn't that actually counteract the argument because that would be Marvin or Mr Briney in his house trying to protect himself yeah but then it also reminds me of that one case where that guy was in the basement and he was like waiting for the kids to break in and then shot them and killed them whate and then he was found guilty it's this really horrific one which they like literally have you can listen to it cuz he was recording it where he was like talking to himself being like you g to come in like you g to come downstairs I'm gonna [ __ ] shoot you like he was like saying but he lured them in like that well I think they had already previously broken in and so he was just waiting it's also hard cuz then it's like stay in your own homes yeah but also it's like it's premeditated you know like oh yeah because he planned it yeah Ed was waiting for someone to miss step to shoot them or so the rumor went

36:00

right objection heay yeah truly we literally have a gavl Thor's hammer boom anyway these demonstrations of stealing the juror's purses and giving all these Point Counterpoint arguments they weren't entirely working for the bres oh and instead the jury sided with Marvin catco that's wild yeah but I also wonder One okay this is so interesting because I'm curious if they were all members of the Town who were a part of the jury because the bres aren't actually active members of the society there so yeah but there there's already like but Bera probably grew up there guess like her parents had lived there her grandparents had live there they're multigeneration right they just didn't live there or maybe they were now residing the next town over right so I don't it's just interesting because it's like there could be some bias towards Marvin because he is a member of the town that

37:00

probably people are interacting with a lot more than with the bres also he was younger again it was said he was attractive and also The Brines were said to be a little bit odd um they were older and grouchier and also they thought that their dead parents SL in-laws lived there so I think like at the time if we had heard that we be like we get it but I think at the time there's probably a lot of people that are like they're crazy yeah yeah so they didn't get much sympathy definitely not as much as Marvin cacco did and they lost they lost and Marvin won he was to be compensated for the damages injuries and medical expenses in total The Brines were now to pay $20,000 in compensatory damages and 10,000 in punitive damages and this was in 1957 so that 30k today would be more like $300,000 it's a lot it's a lot of money forag they didn't have that no exactly so just as many of us would be in the same boat they were like how the [ __ ] am

38:00

I supposed to pay this like this makes absolutely no sense so they were like we're going to appeal this decision so they did that the case then gets escalated to the Iowa Supreme Court who settled on the same verdict the bres are responsible they have to pay this money wow so what do you do do you file for bankruptcy they sold The Farmhouse and the 80 acres of land how much did they get for that uh I actually have no idea it must have been enough to pay this I think I don't know it technically was like I didn't write any of this down but like I think three or four of their neighbors had divvied up the property and like bought some of the property but then there was like leaseback terms for them tenants like it it was I don't know how they ended up doing it but okay that's essentially how they bought their money yes oh that's sad I know So eventually the property like The Farmhouse itself was sold to a like single family

39:00

resident mhm the new owners who took over the house and were I think the first people to actually enter this Farmhouse since this case happened mhm the wire that had rigged the shotgun was still there tied to the bed post so I think like The Farmhouse and all of the stuff that was in it that they were trying so desperately to protect just left was left was abandoned was sold so they still have the wire and they took pictures of it which they I believe use to just like show in law school at times but before I tell you more where do you think you would be if you were a juror because I kind of found myself entirely on the Bry side out of frustration of like thinking I mean I am on the Bry side in the sense that like how infuriating yeah but clearly Marvin had a great lawyer and I feel like when you're in I mean I've never been I'm so I've never been on a jury not yet but I

40:00

feel like when you're in that situation a lawyer tugs on your heartstrings and I don't know I I could see myself being convinced yeah it's hard because I agree with the that The Brines had intent to cause physical harm and not just to scare people right I do think that this would be a very different case if there were signs posted outside that said weapons on property trespassers will be shot I think there's no way in hell Marvin would have won if they had a sign like that if they had that sign but because they didn't the BR lost everything yeah I have sympathy for them but I don't know necessarily which way I would have gone I don't yeah I feel like I would argue more towards the brines but at the same time I'm like well it was Marvin who was almost 30 but what if it was a 12-year-old and they go into this abandoned haunted house and they're playing hideand-seek right I can't discriminate against who the person is that went inside or why they went inside in the end no one even if it's for the

41:00

mistake or just the intent of being on someone else's property should be shot this is why I would be a bad lawyer and probably a bad cop because I'd be like I'd go with my emotions and that's not always how you uh and so maybe you'd be a bad juror and you you won't get to be on or depending on who the lawyer is I'm a good juror I just got kicked you just got kicked yeah hi baby hard hello so the public had a similar reaction to us we're we're confused and also it's like you can argue very vehemently one side or the other sure and just as you think you're on one side you start to like go on to the other side right so some people demanded that the laws be Rewritten to favor the innocent homeowners who are just trying to defend themselves defend their properties no mercy for criminals this is cool I love cases that completely rewrite law yeah well it did in a sense like like definitely you cannot RI up a shotgun sure yes other people sided with

42:00

Marvin the lawyers involved received threatening letters from just like people in the community threatening them for either defending one side or the other whoa a small town too it's like a thousand people yes yeah it's one of those cases that just like really evokes strong feelings because people can see themselves in both parties right is it Laurel or is it yany exactly is it gold and black or white and blue or whatever the freaking thing is white there we go in the end to summarize exactly why this is not okay and why the brines did get charged the issue is booby traps cannot discern between someone who means harm and someone who doesn't so think about like when you were a kid and you'd run around your neighbor's yards playing flashlight tag and blackful sure right like if you were in your house and you looked out and saw that you would know that that person doesn't mean any harm right but if you had just rigged up a shotgun to go off when someone's within a five foot perimeter of your front door that's

43:00

intent to hurt someone or someone's dog yeah or Someone's Child yeah like you cannot discern right an object cannot discern a lot of people cannot discern but true basically that's not why we're here but yeah so basically they were like this booby trap has no idea if it's just like a kid with a lost frisbee or if it's someone who's actually coming to steal a jar or if it's someone coming to kill you and burn your house down like you cannot it doesn't know the difference so you can booby trap your house and so that is why The Brines were found guilty okay it can be considered a wrongful death to anticipate anyone a criminal or non-criminal to set a trap for them you are liable even if it's just meant to scare someone off and never injure anyone at all basically you're not obligated to make the house safe for a trespasser but you cannot deliberately set a deadly trap for a trespasser either sorry to all of you out there who have been planning to set booby traps in your home unfortunately

44:00

for all of you out there booby trap lovers human safety and health still is ranked above property home safety yeah in this case four years after the case Ed Bry was asked if he would change anything about the situation he said no didn't he yeah he said there's one thing I'd do different though I'd have aimed that gun a few feet higher I had a feeling that man well I also would be so freaking angry like I get I get why he yeah would feel that way because they lost everything yeah everything yeah they're a third generation too to have that that Farmhouse too and it's like they're just trying to do anything to deter people right one fatal mistake for them right luckily wasn't fatal for Marvin but in the end neither the bres nor Marvin really came out as winners because right The Brines lost everything Marvin also his reputation like Not only was he so severely injured but his

45:00

reputation was shot he had a really hard time making and maintaining friends so he did suffer a lot with mental illness his own home was burglarized in 1976 and then in 1994 he died by suicide in his front yard with a gun oh it's very sad that's so sad everyone lost in this case really yeah oh so an all-around convoluted and tragic case that has found itself a part of every tort class in law school and it all started because the brines valued another type of Life spectral life and they just wanted birth his parents in their ghostly forms to be able to live peacefully on their Farmhouse to go into the cupboard and into the fridge and get the food they wanted to sit at the table that had been set for them and enjoy a meal or maybe just smell it in their ghostly forms yeah to rest on their own sofas and in their own beds even if they did so from the astral realm so was the house knocked down or does it still stand it was knocked down so the people who bought it who took the wire that had

46:00

rigged the shotgun they destroyed the house to start fresh and new I do Wonder also it wasn't like very taken care I'm sure it probably wasn't Dakota I bet even if they wanted to keep it they probably had to knock it down but I'm curious if like whatever they built on top of that is haunted by The Brines all generations of them you know like yeah that feels like how you start almost a family curse but like the family curse is the family cursing anyone who comes to that land comes there generations of a different type of generational curse everyone teams together teams up we all haunt together yeah I think we as a community the Phantom Community if anyone ever harms anyone in this community we can have a a phantom band of Army of Ghosts we are an army ghosts and ghouls Phantoms haunted friends I will have to remove my one hand to read my story I just did with without looking into what you were doing I just did a quick like Google of the

Listener Story - Haunted Farm

47:00

term and I saw a farmhouse so great I found a story from a listener about a haunted Farmhouse amazing a confirmed haunted Farmhouse correct not just a believed yeah yes this is from Rachel and the subject line is don't read this at night guys be real LOL it's daytime we're good and I think Rachel's a morbid listener because she begins hello fellow weirdos hello my name is Rachel I've got a wordy but necessary one in a million spooky story for you this spooky story being of course non-fiction it's just my life apparently I work on a local Farm it's huge and over 150 years old it's open to the public but only during spooky season so for most of the year I'm out here doing farming which is just a kind word for getting my ass absolutely kicked constantly it's cool though for a couple of months I'm managing an equally ancient Victorian Farmhouse that has also been renovated into a coffee shop and oh that's so cool and I live here so

48:00

my boss is my landlord and I manage the house she used to live in and now I live in the house her parents used to live in wow that's actually sick so it sounds like Rachel does a lot on this property too right which is good yeah and it's nice that live yeah I know it just reminds me of I had a couple of my friends Hillary and Margaret and high school they worked for our like local one of the local farms mhm in the summer they would ire high schoolers to just like go out into the field and pick strawberries so they were like squatting for like eight hours straight oh my gosh I was like you've been bamboozled my friend $10 an hour is not worth it tan though yeah they had big butts so maybe it was worth it do they still have big butts I think so way to go Rachel says to be clear these are two entirely different houses one is a spooky house that is the business and the other is just a regular house they're both on the same property but we'll call the house that I work in The Farmhouse and the other as my house my boyfriend also

49:00

works at the farm and lives with me there was a man that lived in my house after my boss's parents died this man was very sick and a hoarder and he suddenly died and the house became vacant the deal was that my boyfriend and I could renovate it which cost us nothing and we would get a deal for renting it after it was done both of us my boyfriend and I are spiritual people and naturally there's some paranormal ship that was popping off out here all the time so I'm going to get to that soon but this last spring I visited with a psychic for the first time in my entire life in hopes that she could either help me or confirm hey Rachel you're insane she immediately said that I am intuitive and an earth healer that I have gifts and I will be learning from her how to use them she knew what my job was without me mentioning anything and said that the land that we were on is very old and that there are portals that sort of open and closed all over the place it's wild for her to know what Rachel's job was because I feel like if I were given 800 guesses I'm not sure I would ever so un yeah it's extremely

50:00

unique she said that I was a beacon of light for whoever walks out of those portals so it wasn't surprising to know that I got visitors often she also confirmed that the man that had lived in my house before his energy lingers there but he's not a threat before I went to the psychic I had a dream that I was in The Farmhouse I had gotten to work late and I was rushing around like mad trying to turn all the lights on in one of the porches I had seen an old woman sitting on a bench and then from a different door came a knock there was this gorgeous woman standing at the door who had a bunch of golden jewelry hanging from her neck her ears I think even her nose her hair was in locks partially tied up a caramel color she had brown eyes and she was absolutely radiant looking and was so pretty this door she was at was the entrance so I let her in and I apologized I'm so sorry for it being so dark and I offered to make her a drink I remember her order and remember making it and handing it to her and then she had asked me if I had seen the woman outside on the porch I looked over where the woman had been sitting

51:00

and she was gone and I said yeah I did why the woman looked at me and said her name is Viola you don't need to be afraid of her suddenly it was like I was on the ceiling looking down at everything like a very outof body experience and then in a blank I was standing in the middle of the main room at the center of the rug I looked towards where the registers were and felt a gust of wind I woke up then and felt like my hair had been moving as if something was blowing on my face my psychic told me that I have many Spirit guides some are adults some are children and some are even animals so maybe this woman who I had dreamt of was a spirit guide of mine that's so wild to just have someone like show up just like glowing and stunning and being like by the way the person you're seeing is she's good not yeah not to be spooked by you're like what kind of weird ass horror movie series are you living in but that's actually a beautiful experience and if that's her spirit guide you have a hot spirit guide that's a Sil gous gorgeous girls that's a Sil a spirit I'd like to

52:00

[ __ ] oh my God I reminds you I just saw Tik Tok the other day where a guy like really just kind of has a little bit of a mental meltdown because he said something about like a mil and his friend goes they're not mils anymore they're your peers because we're just getting older and it was like he's the same age that's your peer but if it's a mother it's good still works yeah yeah there's a spirit I've nicknamed Tex who I think is a mimic of some sort he walks around upstairs and makes footsteps noises and it seems like he's around a lot mostly when I'm upset or stressed out sometimes when I'm in the upper part of the building I can hear boots walking on the floor downstairs and I'll hear a little whistle like he's trying to get my attention I believe him to be a mimic because my boyfriend is awfully quiet and he knows I spook easily and he also wears boots all the time he'll come into my building a ways and whistle for me instead of yell I'm always thinking it's him downstairs and when I go down there's no one there which is why I

53:00

think it's a mimic here are two other examples of this mimic at work the first one I was coming home from a hair appointment and I had stopped at the store afterwards so I had a few bags with me it was maybe 9:00 p.m. or so and it was very dark by the time I got home I was juggling my bags walking up to my porch when I heard what sounded like someone walking right in front of my yard and then I heard my boyfriend's phone go off I couldn't see a thing so I was like hey are you out there expecting him to come forward yeah there was a Solid 5 Seconds of Silence I felt so uneasy when my boyfriend came in from the garage I said were you outside did you not hear me and he said yeah I was but I was in the back and I said did you check your phone I heard it go off to which he informed me that his phone was on silent huh Second Story with the mimic my coworker is a skeptic that's worth noting she had pulled out of the drive at work leaving for the day when she snapchated me this is a conversation we had had her hey are you home me no

54:00

I'm still at work why her weird I just saw you on your porch me what the [ __ ] what her yeah but you didn't look right so I was just trying to make sure you were okay E doubleganger Yeah but I guess it wasn't you I said what do you mean I didn't look right her you were just sitting there sort of hunched over with your head in your hands and looked like you were going through it anyway we were both pretty out by that one yeah that's really freaky it does make me wonder cuz we've talked about before like pieces of your soul chipping off and going through something and maybe that's how like Paranormal Activity sometimes manifests so it makes me wonder if Rachel did have something big happen to her or was working through something yeah and that just kind of like became a residual haunting or its own haunting interesting I guess only Rachel will be able to tell us yeah the last story I'll tell you and just so you know I have so many more so if you ever want more let me know this is about a strange spirit I saw that took the form of a deer I went to let my dog out at

55:00

night and we have animals that come into the yard often and while my dog is a 100% purebred good girl she is clueless to her surroundings and has a zero prey drive so I always bring a flashlight out with us so I can avoid any raccoons or maybe a grumpy feral cat we do get deer turkeys Etc but they usually book it as soon as we go outside I remember being on the side of the house with my dog and I Pann the flashlight over to the backyard along the side and I was met with two eyes now I was born and raised in rural areas and I know about local Wildlife these eyes were set like deer's eyes except for they were awfully high up yeah deer can be tall but this looked taller than usual I stood there for a couple of minutes just shining the light on it because it felt so weird it didn't move it didn't blink it didn't make any noise nothing that my friend is likely a not deer the other thing it didn't do was cast a silhouette I was shining my light up and down the damn thing and I couldn't make out a body no no ears no antlers no nothing it was just Blackness and eyes H my dog pulled me out of my

56:00

two-minute long investigation and absolutely insisted we went back inside whining scared we went back inside and I told my boyfriend there's something huge out there like a deer but it's really [ __ ] huge we went to the bathroom with my flashlight because my bathroom has a window that faced that side of the yard we shined the flashlight out and it was gone then he Pan the flashlight to the left where we have this large garden bed with awfully large weeds and there it was now closer to the house standing in the same position facing the window unmoving unblinking and then it sort of just walked off I mean like it looked at us saw that we saw it and then it turned and walk off the fact that it was already facing there too it's like it was conscious and trying to observe them right but we never caught a glimpse of its head or its shoulders or ears anything my boyfriend was like no it was a deer but I'm not convinced something was not right about it at all trust your gut and trust your pet your dog was like no and your dog doesn't really get what what did you see nothing well I looked

57:00

in the reflection and just realized that it's pretty dead the plant on the top part that's why I was just observing my lack of remembrance that there is a plant in here anyway thanks for reading my long story I wish all of the time I could chime in and chat with you guys see you on the other side Rachel this is so beyond The Farmhouse this is like all of the land surrounding it yeah I'm curious what area or what part of the country it's too because mhm like not deer I feel like they're Regional maybe if it's like Appalachian adjacent or who knows or what the history of the land was but then like was it a not deer or was it something else was it a a creature flesh pedestrian some sort of creature some sort of shape shifter was it the same thing that's pretending to be Rachel and then pretending to be right or boyfriend or like all these other creatures like is there just something that kind of again mimics strange takes on whatever form it most

58:00

recently fed from perhaps I don't know but that is really spooky very wait do Rachel did she say or at the time of the email was she still there uh that's a good question I don't know I'm curious how long she's been there what the her landlord SL boss has encountered if anything I work on a local farm this was November of 2023 so I don't know Rachel will follow up well cuz the other person that worked there too experience stuff like was seeing Rachel's own doppelganger yeah this is spooky I am very curious where this is this does feel appalachin it does yeah very tell us Rachel tell us and if you have any ghost stories from Farms or life generally please email them to us at two girls1 GOP podcast gmail.com you can rate and review on iTunes Spotify wherever you listen and just tell other people about us who wouldn't want to you know be here for this aren't we fun you know what I also kind of look like if my
